1. Your relationship with youandyourmoney.ie
1.1 The website youandyourmoney.ie is owned by Ashville Media Group Limited (referred to as “Ashville”). “Ashville” means Ashville Media Group Limited having its registered office at Longboat Quay, 57-59 Sir John Rogersons Quay, Dublin 2. Your use of Ashville’s products, services including the Discussion Board and website (referred to as the “Services”) is subject to the terms of a legal Agreement between you and Ashville.
1.2 Unless otherwise agreed in writing with Ashville, your agreement with Ashville will always include, at a minimum, the Terms and Conditions set out in this document.
2. Accepting the Terms.
2.1 In order to use the Services, you must firstly agree to the Terms. You may not use the Service if you do not accept the Terms.
2.2 You may accept the Terms by:

(b) By actually using the Services. In this case you understand and agree that Ashville will treat your use of the Services as acceptance of the Terms from that point onwards.

3. Provision of the Services by Ashville
3.1 Ashville has Subsidiaries and Affiliated Legal entities and Associated Companies (“Associates and Affiliates”). Sometimes these Companies will be providing the Services to you on behalf of Ashville itself. You acknowledge and agree that Associates and Affiliates will be entitled to provide the Services to you.
3.2 Ashville endeavours to provide the best experience for its users. You acknowledge and agree that the form and nature of the Services which Ashville provides may change from time to time without prior notice to you.
3.3 You acknowledge and agree that Ashville may stop (either permanently or temporarily) providing the Services (or any part or parts thereof) to you or to users at Ashville’s absolute discretion, without prior notice to you. You may stop using the Services at any time. You do not need to inform Ashville when you stop using the Services.
3.4 You acknowledge and agree that if Ashville disables access to your account, you may be prevented from accessing the Services, your account details or any files or other content which is contained in your account.
3.5 You acknowledge and agree that Ashville shall be entitled to edit and/or remove any postings by you on the website at Ashville’s absolute discretion.

7.2 In particular Ashville, its Associates and Affiliates and Subsidiaries do not represent or warrant to you that:
(a) Your use of the Services will meet your requirement
(b) Your use of the Services will be uninterrupted, timely, secure or free from error
(c) Any information obtained by you as a result of your use of the Services will be accurate or reliable, and
(d) That defect in the operation or functionality of any software provided to you as part of the Services will be corrected.
7.3 No Conditions or Warranties or other Terms (including any implied Terms) as to satisfactory quality, fitness for purpose or non-conformance with description apply to the Services except to the extent that they are expressly set out in the Terms.
7.4 Nothing in the Terms shall affect those Statutory Rights which you are always entitled to as a Consumer and that you cannot contractually agree to alter or waive.
8. Limitation of Liability
8.1 NEITHER ASHVILLE NOR ANY OF ITS ASSOCIATES, OR AFFILIATES OR SUBSIDIARIES OR PARTNERS MAKES ANY WARRANTY THAT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL THAT YOU PURCHASE OR OBTAIN FROM THE USE OF OUR SERVICES WILL MEET YOUR EXPECTATIONS OR THAT ANY ERRORS WILL BE IMMEDIATELY CORRECTED. NEITHER WE NOR ANY OF OUR PARTNERS MAKE ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO OUR WEBSITES, ANY CONTENT OR ANY OF OUR SERVICES, TO, PRODUCTS OR PROPERTIES, AND YOU EXPRESSLY AGREE THAT YOU WILL ASSUME THE ENTIRE RISK AS TO THE QUALITY AND THE PERFORMANCE OF OUR SERVICES AND THE ACCURACY OR COMPLETENESS OF ITS CONTENT.
8.2 Nothing in these Terms shall exclude or limit Ashville’s liability for losses which may not be lawfully excluded or limited by applicable law.
8.3 Subject to overall provision in this paragraph Ashville, its Associates and Affiliates, or Subsidiaries or Partners shall not be liable to you for:
(a) Any indirect or consequential losses which may be incurred by you. This shall include any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation, or any loss of data suffered by you;
(b) Any loss or damage which may be incurred by you as a result
of:
(i) Any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the Services;
(ii) Any changes which Ashville may make to the Services, or for any permanent or temporary cessation in the provision of the Services (or any features within the Services);
(iii) The deletion of, corruption of, or failure to store, any content and other communications, data maintained or transmitted by or through your use of the Services;
(iv) Your failure to provide Ashville with accurate account information;
(v) You failure to keep your password or account details secure and confidential.
8.4 The Limitations on Ashvilles liability to you
8.3 above shall apply whether or not Ashville has been advised of or should have been aware of the possibility of any such losses arising
9. Copyright and Trademark Policies
9.1 It is Ashvilles Policy to respond to notices of alleged Copyright infringement that comply with applicable international Intellectual Property Law and in terminating the accounts of repeat infringers.
10. Intellectual Property
All of the contents on our website and any Service we provide is protected by Irish and International Copyright Laws and is the property of Ashville and/or the providers of the content under Licence. By “Content” we mean any information, mode of expression, or other materials and Services found on youandyourmoney.ie. This includes message boards, Discussion Boards, blogs, chats, software, contributions from Staff or Consultants to youandyourmoney.ie, graphics, and any and all other features.
You may make one copy of the content for your personal, non-commercial use, provided that any material copied remains in tact and includes the following notice:

By posting content, you agree that Ashville has an unlimited and perpetual Licence to re-publish anything you post on our websites, but you retain the right to use your words as you wish. If you do not wish Ashville or youandyourmoney.ie to republish your words, please do not post them on our websites or Services.
You agree not to display any of Ashvilles Trademarks or use them in any manner without our express written permission.
11. Advertisement
11.1 Some of the Services are supported by Advertising Revenue and may display advertisements and promotions. These advertisement may be targeted to the content information stored on the Services, queries made through the Services or other information.
11.2 The manner mode and extent of advertising by Ashville on the Services are subject to change without specific notice to you.
11.3 In consideration for Ashville granting you access to and use of the Services, you agree that Ashville may place such advertising on the Services.
11. Other content
12.1 The Services may include hyperlinks to other websites or content or resources. Ashville may have no control over any websites or resources which are provided by Companies or persons other than Ashville.
12.2 You acknowledge and agree that Ashville is not responsible for the availability of any such external sites or resources, and does not endorse ay advertising, products or other materials on or available from such websites or resources.
12.3 You acknowledge and agree that Ashville is not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on or available from such websites or resources.
13. General
13.1 Sometimes when you use the Services you may use a Service or purchase goods which are provided by another person or Company. You use of these other Services, or goods may be subject to separate terms between you and the Company or person concerned. If so the Terms do not affect your legal relationship with these other Companies or individuals.
13.2 The Terms constitute the whole Legal Agreement between you and Ashville and govern your use of the Services (but excluding any Services which Ashville may provide to you under a separate written Agreement), and completely replace any prior Agreements between you and Ashville in relation to the Services.
13.3 You agree that Ashville may provide you with Notices, including those regarding changes to the Terms, by email, regular mail or postings on the Services.
13.4 You agree that if Ashville does not exercise or enforce any legal right or remedy which is contained in the Terms (or which Ashville has benefit under any applicable Law), this will not be taken to be a formal waiver of Ashvilles rights and those rights and remedies will still be available to Ashville.
13.5 The Terms and your relationship with Ashville under the Terms shall be governed by Irish Law. You and Ashville agree to submit to the exclusive Jurisdiction of the Courts of Ireland to resolve any legal matters arising from the Terms. Notwithstanding this, you agree that Ashville shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any Jurisdiction.
13.6 You are prohibited from using this site to post or transmit any unlawful, threatening, defamatory, malicious or injurious falsehood, obscene, scandalous, inflammatory, pornographic or profane material that could or be deemed, to constitute or encourage unlawful or illegal conduct. Ashville its Servants, Employees or Agents will, from time to time, monitor or review material transmitted or posted by persons using this website and reserves the right to delete any material deemed inappropriate. In addition Ashville assume no responsibility or liability arising from any material posted on this site.
13.7 Your linking to any sites from this website is at your own risk. By linking to a site or permitting a link to this site, Ashville does not endorse the site operator or the content of the links site.
13.8 In using the Discussion Board you agree to also be bound by the rules of the Discussion Board and users found to be in breach of such rules may be permanently barred from accessing the site at Ashville’s absolute discretion.
